Brian, I would certainly not give up on the pedal without giving us a shot here at the forum to help you get it working. Suggest that you start a new thread, and post photos of your build & supporting details as described here: viewtopic.php?f=19&t=6026

As much as I hate to admit it, it was my soldering. I had a cap that had grounded and some of my solder points, while they looked nice, we're cold. I was afraid I had overheated a few spots as well but found it is near impossible to do that even with my 40 watt iron. Duhvoodooman helped me out, fixed my solder issues and gave me some great tips for next time. If he offers to fix it for you, he is legit and I would recommend him.
